New Labour Codes Come Into Force; All Workers to Get PF, ESIC & Insurance Benefits

India’s new labour reforms have officially come into effect from 21 November 2025, marking a major shift in the labour ecosystem. The Centre announced that all four new Labour Codes — the Code on Wages (2019), Industrial Relations Code (2020), Code on Social Security (2020) and Occupational Safety, Health & Working Conditions Code (2020) — are now fully implemented.

Under the Social Security Code, the government has ensured that every worker, including gig workers and platform workers, will be covered under social security. This means that PF, ESIC, insurance, gratuity and other benefits will extend beyond traditional employment and reach India’s expanding gig economy workforce.

The labour ministry said this transformation has replaced 29 fragmented labour laws that were drafted decades ago, during the pre- and post-Independence era, and no longer aligned with today’s workplace realities. The revamped regulations are designed to support a future-ready workforce, reduce compliance burdens, and build stronger, more resilient industries for an Aatmanirbhar Bharat.

According to the government, the new framework allows India to finally move away from outdated colonial-era structures and embrace global standards of labour protection. The ministry highlighted that these reforms not only protect workers but also provide businesses greater clarity and flexibility — helping them remain competitive in a fast-changing world.


Key Benefits Across Worker Categories

1️⃣ Fixed-Term Employees (FTE)

  • Full benefits at par with permanent staff — leave, medical, social security
  • Gratuity after just one year (earlier five years)
  • Equal wages to permanent employees
  • Encourages direct hiring over contractual jobs

2️⃣ Gig & Platform Workers

  • Legal recognition of gig and platform work for the first time
  • Aggregators must contribute 1–2% of turnover toward worker welfare
  • Aadhaar-linked Universal Account Number ensures benefits remain portable across states

3️⃣ Contract Workers

  • Health benefits and social security coverage
  • Annual health check-up mandatory
  • Enhanced protection against exploitation

4️⃣ Women Workers

  • Equal pay for equal work guaranteed
  • Women allowed in all shifts (including night shift) with safety provisions
  • Compulsory women representation in complaint committees
  • Family definition expanded to include parents-in-law for dependent benefits

5️⃣ Youth Workers / New Workforce Entrants

  • Minimum wages ensured for all employees
  • Appointment letters mandated → increasing formal employment and financial security
  • Wages must continue during leave to prevent exploitation
  • Wages based on government-defined floor wage to ensure decent living standards
